TERMS & CONDITIONS
OF BOOKING & SERVICE

PART A โ€” BOOKINGS AND CONTRACT FORMATION

1. BUSINESS INFORMATION
The supplier and contracting party is Merseybeatz Entertainment Ltd. Trading as: Merseybeatz Entertainment. Company number: 16207834. Registered in England and Wales. Email: info@merseybeatz.com | Telephone: 07400 101321.

Throughout these Terms & Conditions:
โ€œMerseybeatzโ€, โ€œweโ€, โ€œusโ€ or โ€œourโ€ means Merseybeatz Entertainment Ltd.
โ€œClientโ€, โ€œcustomerโ€, โ€œyouโ€ or โ€œyourโ€ means the person, company or organisation making the booking.
โ€œEventโ€ means the occasion for which our services are booked.
โ€œServicesโ€ means any entertainment, equipment, or hosting supplied or arranged by us.
โ€œBooking Agreementโ€ means the quote, confirmation, invoice, and these Terms together.

2. QUOTATIONS AND AVAILABILITY
2.1 Any quotation is subject to availability and written confirmation.
2.2 An enquiry does not reserve a date.
2.3 Availability may change until a booking has been formally confirmed.

3. WHEN A BOOKING BECOMES CONFIRMED
3.1 A booking becomes confirmed when: a) we have accepted the booking; b) the Client has supplied required info; c) any Booking Agreement requested has been accepted; and d) the required booking fee has been received.
3.2 Once confirmed, the Booking Agreement constitutes a binding contract.

PART B โ€” PRICES AND PAYMENT

4. PRICES
4.1 The price payable will be shown in the confirmed quotation.
4.2 Additional performance time requested may be charged at our current additional-hours rate.

5. BOOKING FEES AND ADVANCE PAYMENTS
5.1 We require a booking fee to reserve the Event date and begin administration.
5.2 Any amount retained following cancellation will be subject to applicable consumer law.

6. BALANCE PAYMENTS
6.1 The remaining balance must be paid by the date specified on the invoice.
6.2 Unless agreed otherwise, all amounts must be cleared before the Services begin.

7. ADDITIONAL TIME AND OVERTIME
7.1 Performance beyond the contracted finish time is subject to performer availability and Venue permission.
7.2 Additional time cannot be guaranteed on the Event date.

PART C โ€” CLIENT RESPONSIBILITIES

8. ACCURATE EVENT INFORMATION
8.1 The Client must provide accurate info concerning Event date, Venue, address, timings, and technical requirements.
8.2 Merseybeatz is not responsible for cost increases caused by incorrect info.

9. VENUE ACCESS
9.1 The Client must ensure the Venue permits adequate access for setup and removal.
9.2 Reasonable setup time must be available before the performance time.

10. PARKING AND TRAVEL
10.1 The Client may be responsible for parking, toll, or congestion charges unless included in the quotation. Travel charges will normally be identified separately on the quotation.

PART D โ€” TECHNICAL REQUIREMENTS

12. PERFORMANCE AREA & POWER
12.1 The Venue must provide a safe, stable, and suitable area for the Services.
13.1 The Venue must provide a safe electrical supply adequate for the booked equipment.

14. SOUND LIMITERS
14.1 The Client must inform us if the Venue operates a sound limiter.
14.2 We cannot guarantee a particular sound volume where limiters are imposed by the Venue.

15. PAT TESTING & INSURANCE
15.1 Merseybeatz uses professional, maintained equipment.
15.2 Merseybeatz maintains public liability insurance appropriate to its operations.

PART E โ€” MUSIC & PERFORMANCE

16. MUSIC SELECTION
16.1 Clients are encouraged to supply preferences before the Event.
16.3 The DJ retains professional discretion over music order, transitions, and flow.
17.1 Guest requests may be accepted at the discretion of the DJ.

19. DJ SUBSTITUTION
19.1 If a scheduled DJ is unavailable (illness/emergency), Merseybeatz may provide a suitable replacement.

PART F โ€” ADDITIONAL EQUIPMENT

21. BOOTHS AND INTERACTIVES
21.1 Interactive equipment is subject to Venue access and mobile connectivity.
21.3 The Client may be charged for deliberate damage to equipment or props.

23. SPECIAL EFFECTS
23.1 Haze, confetti, and sparks are subject to Venue approval.
23.2 Merseybeatz may refuse to operate effects if deemed unsafe or contrary to Venue instruction.

PART G โ€” TIMINGS & DELAYS

25. EVENT DELAYS
25.1 We accommodate ordinary Event delays where possible.
25.3 The contracted finish time remains unchanged if the Event begins late for reasons outside our control.

26. EARLY SETUP
26.1 If the Venue requires setup substantially earlier than the start time, additional charges may apply.

PART H โ€” CLIENT AND GUEST CONDUCT

27. SAFE WORKING ENVIRONMENT
27.1 The Client is responsible for ensuring Merseybeatz staff can operate safely.
28.3 We may end Services immediately where there is a serious or imminent risk to people or property.

29. EQUIPMENT DAMAGE
29.2 Where equipment is negligently damaged by the Client or their guests, we may seek reimbursement for repair or replacement.

PART I โ€” OUTDOOR EVENTS & WEATHER

30. OUTDOOR PERFORMANCES
30.1 Must be agreed in advance. Suitable weatherproof cover and level flooring must be provided.
31.2 If weather prevents safe performance, parties will consider moving indoors or postponement.

PART J โ€” CANCELLATIONS & CHANGES

32. CHANGES TO A BOOKING
32.1 Requests to change date or Venue must be made as soon as possible.
33.1 Transferring a booking is subject to availability.

34. CANCELLATION BY CLIENT
34.5 Where a Client cancels, Merseybeatz may retain or claim only a reasonable amount reflecting losses directly resulting from the cancellation (indicative scale: up to 100% depending on notice period).

37. CANCELLATION BY MERSEYBEATZ
38.2 If we cannot provide Services for reasons we are responsible for, we will use efforts to provide a substitute or a refund.

FORCE MAJEURE & COMPLAINTS

39. FORCE MAJEURE
39.1 Neither party is at fault for failure caused by circumstances genuinely outside their reasonable control (weather, health restrictions, government actions).

49.1 Formal complaints should be sent to info@merseybeatz.com.

BOOKING ACCEPTANCE: By confirming a booking with Merseybeatz Entertainment Ltd, the Client confirms they have read these Terms & Conditions and agrees they form part of a binding Booking Agreement.
